Is it possible to adjust the information included in the annual report on purchases from small and medium-sized businesses posted in the Unified Information System?

In a letter prepared by specialists of the Ministry of Finance of the Russian Federation, in particular, it is noted that, by itself, making changes to the annual report does not automatically entail the recognition of posted information on the annual volume of purchases from small and medium-sized businesses as unreliable. The recognition of such information as unreliable should be carried out in each case separately based on the actual circumstances. At the same time, the fact that information on the annual volume of purchases from small and medium-sized businesses is unreliable or not posted in a Single information System may be appealed in accordance with paragraphs 6, Part 10 and Part 12 of Article 3 of Law No. 223-FZ to the antimonopoly authority.

Recall that in case of non-fulfillment by the customer of the obligation to make purchases from small and medium-sized businesses during a calendar year in the amount established by the Government of the Russian Federation, or posting false information about the annual volume of purchases from small and medium-sized businesses, or failure to place a procurement report from small and medium-sized businesses in a Unified information System, the procurement regulations for this the customer from February 1 of the year following the last calendar year, and until the end of this year, it is recognized as unplaced in accordance with the requirements of Law No. 223-FZ. In this case, the customer, when purchasing, is guided by the provisions of Law No. 44-FZ within the limits provided for in Part 8.1 of Article 3 of Law No. 223-FZ.
