The Ministry of Health spoke about the shortcomings and violations committed by customers when making purchases under Law No. 44-FZ
The Ministry of Health of the Russian Federation has identified systemic deficiencies in the activities of subordinate customers and violations of the provisions of Law No. 44-FZ and other regulatory legal acts on the contract system, as well as the terms of contracts, including in terms of:
- non-compliance with the deadlines established by Law No. 44-FZ for payment of the results of the execution of contracts;
- changes in the essential terms of contracts in the absence of grounds provided for by law;
- acceptance and payment of outstanding works;
- non-payment of penalties to counterparties;
- non-use of the supplied and paid equipment for its intended purpose;
- non-examination of the results of the execution of contracts.
In order to eliminate these violations, the heads of institutions subordinate to the Ministry of Health of the Russian Federation are instructed:
- ensure strict compliance with the requirements established by the regulatory legal acts of the Russian Federation;
- organize work on the implementation of internal control and risk assessment of identified violations;
- take comprehensive measures to prevent violations of the legislation of the Russian Federation in the future.
