The range of customers who do not use a single trade aggregator when making purchases has been expanded

According to the amendments made to paragraph 6 of the Decree of the Government of the Russian Federation dated 04/28/2018 No. 824-r (hereinafter referred to as Order No. 824-r), Rosreserv and federal state institutions under its jurisdiction are exempt from the obligation to carry out purchases specified in paragraph 1 of Order No. 824-r using a single trade aggregator.

The Decree of the Government of the Russian Federation dated 17.01.2024 No. 38-r entered into force on January 17 of this year.

Recall that according to paragraphs 1, paragraph 6 of Order No. 824-r, purchases based on paragraphs 4, paragraph 5 and paragraph 28 of Part 1 of Article 93 of Law No. 44-FZ using a single trade aggregator are, as a general rule, required to be carried out by customers who are federal executive authorities and federal state-owned enterprises under their jurisdiction institutions. The exceptions are purchases:

- customers included in the list provided for in paragraph 5 of Part 11 of Article 24 of Law No. 44-FZ;

- a federal executive authority that carries out purchases to meet the federal needs of state bodies formed to ensure the activities of the President of the Russian Federation and the Government of the Russian Federation;

- containing information constituting a state secret;

- carried out on the territory of a foreign state to ensure the activities of customers in this territory;

- services provided by individuals who are not individual entrepreneurs;

- goods, works and services at a price lower than that at which the purchase could be carried out using the EAT, or if there are no goods, works, services in the EAT that meet the needs of customers (paragraphs 6, 7, 9 of Order No. 824-r).
