On the non-application of restrictions on the admission of radio-electronic products in the procurement of works (services)

The Ministry of Finance of the Russian Federation, the Ministry of Industry and Trade of the Russian Federation, the Ministry of Finance of the Russian Federation and the Ministry of Construction of the Russian Federation issued a joint letter dated 20.11.2023 "On restricting the admission of goods that are radio-electronic products and originating from a foreign state when purchasing construction works to meet state and municipal needs."

Recall that according to the provisions of paragraph 3 of the Decree of the Government of the Russian Federation No. 878 of July 10, 2019 (hereinafter referred to as Resolution No. 878), a restriction has been established when purchasing goods that are radio-electronic products included in the list approved by Resolution No. 878. At the same time, when purchasing works in the construction sector, the object of purchase is work.

Resolution No. 878 does not contain a requirement for its application in the procurement of works (services), during the performance (provision) of which the goods included in the list approved by Resolution No. 878 are delivered.

Thus, according to the text of the letter, Resolution No. 878 is not currently applied in the procurement of works, including in the construction sector. Similarly, Resolution No. 878 does not apply to the procurement of services.
