The draft on changing the procedure of public procurement between state customers of the Russian Federation and suppliers from the Eurasian Economic Union was adopted in the first reading

The State Duma adopted in the first reading draft Federal Law No. 390953-8 "On Amendments to Articles 105 and 112 of the Federal Law "On the Contract System in the Procurement of Goods, Works, Services for State and Municipal Needs" (in terms of ensuring the execution of contracts by foreign procurement participants and their complaints). Submitted by the Government of the Russian Federation on 06/28/2023.

"It is proposed to establish the right of foreign participants in public procurement, to use paper document management, to exchange documents without using a Unified Information System in the field of procurement in the execution of the contract, as well as in interaction with control authorities when appealing the results of procurement. This relaxation will be temporary - until the completion of the procedures for the recognition of electronic signatures of foreign states in Russia, including the countries of the Eurasian Economic Union until 2025," said Maxim Topilin, Chairman of the State Duma Committee on Economic Policy.

The Head of the Committee added that in this regard, Federal Law 44 establishes a transitional provision, according to which, until the completion of such recognition in respect of the relevant State, the exchange of documents between the parties to a contract concluded with a procurement participant whose place of registration is the specified state, during the execution of the contract is carried out without the use of a Unified information system in the field of procurement.
