A new case of purchase from a single counterparty has been established under Federal Law No. 44

Part 1 of Article 93 of Federal Law No. 44 from July 1, 2024 has been supplemented with a new paragraph 6.1, which provides for the possibility of procurement by executive authorities of the subject of the Russian Federation by state institutions of the subject of the Russian Federation, municipal institutions of municipalities that are part of the subject of the Russian Federation from a single counterparty:

- medicines;

- specialized medical nutrition products;

- medical devices;

- consumables;

- disinfection products;

- services for storage and delivery of the specified goods;

- repair and maintenance of medical devices.

Contractors for these purchases may be state unitary enterprises of the relevant subject of the Russian Federation or joint-stock companies, 100% of whose shares belong to the relevant subject of the Russian Federation.

Customers will be required to notify the control authority about the purchase. You will also need to justify the contract price and include this justification in the contract.

In addition, on August 4 of this year, a new part 76 was included in Article 112, which provides for the right of executive authorities of the subjects of the Russian Federation, state institutions of the subjects of the Russian Federation, municipal institutions of municipalities that are part of the subject of the Russian Federation to purchase the above-mentioned goods, works and services from State unitary Enterprises until June 30, 2024 the relevant subject of the Russian Federation, endowed with the necessary powers. When making such a purchase, the customer sends a notification of the purchase to the control authority. Notification of the purchase is not required. When making the specified purchase, the customer determines and justifies the contract price and includes the justification in the contract.
