The Ministry of Transport plans to cancel the order approving the standard conditions of the contract for the construction of highways
In connection with the publication of resolutions of the Government of the Russian Federation dated 08.04.2023 N 572 "On approval of standard terms of contracts for the repair of highways, artificial road structures" and dated 29.06.2023 N 1066 "On standard terms of contracts for the construction, reconstruction, overhaul, demolition of capital construction", it is planned to recognize the order as invalid Ministry of Transport of the Russian Federation dated 05.02.2019 N 37 "On approval of standard terms of contracts for construction (reconstruction), major repairs, repair of highways, artificial road structures and an information map of standard contract terms". It is assumed that the relevant regulatory legal act will enter into force on September 1, 2023.
Recall that Part 12 of Article 8 of Federal Law No. 360 dated 02.07.2021 established that the terms of standard contracts and standard terms of contracts approved before the date of entry into force of the said Federal Law are applied in the part that does not contradict Federal Law No. 44, before the approval by the Government of the Russian Federation of standard terms of contracts.
