What maximum values can be reached by the amounts of contract enforcement and advance payment specified in the notice
According to experts of the Treasury of Russia, when forming a notice of procurement, the customer has the right to establish contract enforcement, including in the amount of 30% of the NMCC, advance payments - in the amount of 50% of the NMCC.
Recall that according to Part 6 of Article 96 of Law No. 44-FZ, if the customer establishes a requirement to ensure the performance of the contract, the amount of such security is generally set in the range from 0.5% to 30% of the NMCC. And in accordance with paragraph 2 of the Decree of the Government of the Russian Federation of 06.03.2023 N 348, the relevant customers provide for advance payments in the amount of 30% to 50% of the contract price in their contracts.
