The Ministry of Finance spoke about the specifics of determining the initial maximum contract price in the case of the purchase of security services by a budget institution
Representatives of the Ministry in their letter, in particular, noted that the initial maximum price of the contract, in the case of procurement of security services by a budgetary institution, is determined on the basis of the provisions of the Procedure approved by Order of Rosgvardiya No. 45 dated 02/15/2021. At the same time, taking into account that the costs for the purchase of goods, works and services must correspond to the indicators of the schedule, the initial maximum price of the contract for the provision of security services should not exceed the expenses of the budget institution provided for in the schedule for the purchase of such services.
Recall that by virtue of Part 22 of Article 22 of Federal Law No. 44, the Government of the Russian Federation has the right to determine:
- areas of activity in which, when making purchases, the procedure for determining the initial maximum contract price, the initial unit price of goods, work is established;
- federal executive authorities, Rosatom State Corporation, Roscosmos State Corporation, authorized to establish such an order taking into account Federal Law No. 44.
Currently, in accordance with Part 22 of Article 22 of Federal Law No. 44, in addition to the above Procedure, approved:
- The procedure for determining the initial maximum contract price when purchasing medicines for medical use (Order of the Ministry of Health of the Russian Federation No. 1064n dated 19.12.2019);
- The procedure for determining the initial maximum contract price when making purchases in the field of urban planning (with the exception of territorial planning) (Order of the Ministry of Construction of the Russian Federation dated December 23, 2019 No. 841/pr);
- The procedure for determining the initial maximum contract price when purchasing medical devices (Order of the Ministry of Health of the Russian Federation No. 450n dated 05/15/2020);
- The procedure for determining the initial maximum contract price when making purchases in the field of regular transportation of passengers and luggage by road and urban ground electric transport (Order of the Ministry of Transport of the Russian Federation No. 351 dated 10/20/2021);
- The procedure for determining the initial maximum contract price, the initial unit price when purchasing shipbuilding industry products (with the exception of products purchased under the state defense order) (Order of the Ministry of Industry and Trade of Russia dated 02/28/2023 No. 639).
