What procurement methods will allow customers to ensure the achievement of the mandatory share of purchases from small and medium-sized businesses?
According to experts of the Ministry of Finance of the Russian Federation, customers guided by Federal Law No. 223 can fulfill the requirement to make purchases with the participation of exclusively small and medium-sized businesses in the prescribed amount by conducting:
- competitive procurement in electronic form, in which only small and medium-sized businesses can be participants, the specifics of which are established by Article atiya 3.4 of Federal Law No. 223;
- non-competitive procurement using the "electronic store" mechanism, if the terms of such procurement provide for the participation of only small and medium-sized businesses in it;
- non-competitive procurement involving the participation of several procurement participants, but only from among small and medium-sized businesses.
Recall that the total annual value volume of contracts concluded by customers with small and medium-sized businesses based on the results of purchases among small and medium-sized businesses should be at least 20% of the volume of all contracts concluded by customers based on the results of purchases.
