The President gave a number of instructions concerning procurement legislation following a meeting with Delovaya Rossiya
On May 26, the President of the Russian Federation met with members of the All-Russian Public Organization "Business Russia". Following the meeting, a list of instructions was approved, including those related to procurement legislation.
Thus, the Government of the Russian Federation was instructed to consider the issues of:
- non-bringing to administrative responsibility of legal entities and officials for non-fulfillment by the counterparty of obligations under the contract in connection with the occurrence of circumstances beyond his control as a result of the imposition of sanctions and (or) restrictive measures (paragraph three of subparagraph "a" of item 1 of the List);
- the possibility of replacing, during the execution of the contract, foreign goods or goods in the production of which foreign materials and components are used, or goods containing foreign components, the import of which into the Russian Federation is prohibited or restricted as a result of the imposition of sanctions and (or) restrictive measures, with similar goods corresponding to the terms of reference (as agreed with the customer) (the fourth paragraph of subparagraph "a" of item 1 of the List).
The Government of the Russian Federation, together with the Bank of Russia, as well as with the participation of Delovaya Rossiya, was instructed to consider the possibility of concluding a financing agreement for the assignment of a monetary claim (factoring agreement) in procurement under Federal Law No. 223 (paragraph three of subparagraph "b" of item 2 of the List). The report must be prepared by August 1, 2023.
In addition, the state authorities of the constituent entities of the Russian Federation are recommended to take measures aimed at increasing the amount of advance payments under contracts to 50% in 2023 (item 7 of the List). The report must be prepared by August 1, 2023.
