Is it necessary to establish a ban on the admission of foreign software in the case of the purchase of goods with embedded software?
Specialists of the Ministry of Digital Development, Communications and Mass Communications of Russia in their letter, in particular, noted that the ban on the admission of foreign software, established in accordance with the Decree of the Government of the Russian Federation dated 16.11.2015 N 1236 "On the establishment of a ban on the admission of software originating from foreign countries for the purposes of procurement for state and municipal needs", applies to the purchase, if its terms provide for the installation of software on the purchased equipment and the transfer of rights to it.
At the same time, this prohibition applies to all classes of software provided by the classifier of programs for electronic computers and databases approved by the order of the Ministry of Digital Development, Communications and Mass Communications of Russia dated 22.09.2020 N 486. There are no exceptions for cases when the customer purchases equipment with embedded software.
