What terms of the contract can be changed on the basis of part 65.2 of Article 112 of Law No. 44-FZ?
In particular, a letter prepared by representatives of the Ministry of Finance of the Russian Federation notes that on the basis of part 65.2 of Article 112 of Law No. 44-FZ, it is exclusively possible to increase or decrease the amount of medicines, medical devices, consumables provided for by the contract by no more than 30%. At the same time, it is allowed to change the contract price in proportion to the adjustment of the quantity of these goods also by no more than 30%. When making a decision provided for in Part 65.2 of Article 112 of Federal Law No. 44, the contract price is taken into account, taking into account previously made changes based on paragraph 1.2 of part 1 of Article 95 of Federal Law No. 44.
Recall that by virtue of part 65.2 of Article 112 of Federal Law No. 44, until December 31, 2023, by agreement of the parties, it is allowed to change (within the limits established by this norm) the essential terms of the contract, the subject of which is the supply of medicines, medical devices, consumables.
