The Ministry of Finance explained that some legal entities are exempt from quotas for purchases from NSR and SONCO.
The Agency recalled that in accordance with Part 4 of Article 15 of Law No. 44-FZ, when legal entities purchase from funds provided from the budgets of the budgetary system of the Russian Federation (if the conditions for the provision of such funds provide for compliance with the provisions of 44-FZ), the provisions of the law governing relations in determining suppliers, concluding contracts, monitoring, audit and control.
However, as the Ministry of Finance emphasizes, under Part 4 of Article 15 of Law No. 44-FZ, legal entities are required to comply with the procedures for determining a supplier (contractor, contractor). At the same time, achieving the volume of purchases from SMP and SONKO set out in Part 1 of Article 30 of Law No. 44-FZ is not required.
Thus, when making purchases by legal entities within the framework of 44-FZ under Part 4 of Article 15, the obligation to comply with the minimum volume of purchases from small businesses and socially oriented NGOs does not apply to them.
