Amendments to the bank guarantee for purchases from SMSP under Law No. 223-FZ passed the first reading
They plan to introduce requirements for a security guarantee in competitive procurement from SMSP under Law No. 223-FZ. So, the customer will accept guarantees of banks from the list under the Law N 44-FZ. Information about them must be in one of the registers under this law.
The warranty includes a number of conditions, in particular, about the validity period:
• at least 1 month from the deadline for submitting applications — to secure applications;
• at least 1 month from the date of the end of the term of performance of the main obligation - to secure the contract.
The guarantee to secure the contract has nuances. For example, it should not contain a condition for providing the bank with judicial acts in support of outstanding obligations.
The Government will approve, among other things, additional requirements for the guarantee and its standard form.
It is planned that the innovations will work from January 1, 2022.
