The Ministry of Finance of the Russian Federation spoke about the nuances of conducting purchases of goods from a single supplier in electronic form in accordance with Law No. 44-FZ
The Ministry explained the provisions of the Federal law of April 5, 2013 № 44-FZ "On the contract system in procurement of goods, works, services for state and municipal needs" governing procurement of goods from a single supplier in electronic form on the amount under part 12 of article 93 of the Law No. 44-FZ, which, as we will enter into force on 1 April (Letter of the Ministry of Finance of Russia dated February 12, 2021 № 24-06-08/9591).
In particular, the specialists of the Ministry of Finance of the Russian Federation noted in their letter that all persons registered in the UIS will be able to participate in these purchases. Preliminary proposal referred to in subsection 2 CH. 12, article 93 of the Law No. 44-FZ, recognized by the application for participation in the procurement submitted by the participant purchasing from the operator of the electronic platform of action, under the sub-item "a" of section 5 of the said part, the implementation of such actions with the requirements of part 9 of article 24.2 of the Law No. 44-FZ ceases to be three months before the date of expiration of the participant purchases in the EIS. At the same time, the formation of several preliminary proposals is not provided, and the operator of the electronic platform has the right to charge a fee for participation in these electronic procedures.
It is also emphasized that the maximum minimum size of the contract when purchasing goods from a single supplier in electronic form is not limited. At the same time, these purchases are carried out within the total annual volumes provided for in paragraphs 4 and 5 of Part 1 of Article 93 of Law No. 44-FZ.
In addition, the procedure for selecting applications by the operator of the electronic platform has been clarified.
