The Ministry of industry and trade proposed to establish a ban on the admission of foreign electronics to public procurement

A list of foreign electronic and electrical products with a ban on admission has been prepared. Now most of the products from this list are included in the list of foreign REPS with restricted access. They plan to cancel it. Read more in our review.
What products will be banned
From January 1, 2021, they want to introduce a ban on the admission of foreign electronic and electrical products from the special list (paragraphs 1 and 16 of the draft resolution). It will also apply to products (paragraph 5 of the draft resolution):

which is delivered when performing work (rendering services);
it is the subject of lease and / or leasing.
Among other things the list includes the following items OKPD2:

26-computer, electronic and optical equipment (excluding certain items);
27.4-electric lighting equipment;
27.51 — household electrical appliances.
Until January 1, 2023, the ban will not apply to some cables and wires from the EAEU, and from the beginning of 2023-to the rest of the products from the EAEU (paragraphs 2 and 16 of the draft resolution).

When can I purchase foreign goods
The customer will be able to purchase foreign products in the following cases (paragraph 3 of the draft resolution):

if it gets permission from the Ministry of industry and trade. The procedure for issuing it will be determined by January 1, 2021;
purchases products that are not covered by the ban. The procedure for forming the list of such products will also be established before January 1, 2021;
purchases spare parts and consumables for the customer's electronic products, if it is necessary to meet the requirements of technical documentation.
How to confirm that the product is from the Russian Federation or the EEU
Information about products must be (item 6 of the draft resolution):

in the register of Russian electronic products — for goods from the Russian Federation (it will be created separately); in the
register of Eurasian industrial products-for goods from the EAEU.
Procurement participants must document that the product is not foreign (paragraph 7 of the draft resolution).

For example, a participant with an offer of Russian goods will give a Declaration in the application that its products are included in the register, and indicate the number of the register entry. These rules do not apply to accepted military equipment and certain other goods. When purchasing from a supplier, supporting documents must be submitted before the contract is concluded.

What rules should I follow when purchasing with a ban
When you purchase with the prohibition should observe the following rules:

you can not combine products from the list and those that are not included in it into one purchase (item 9 of the draft resolution);
if the customer has received permission to purchase a foreign product, the characteristics of the latter in the notification must be identical to the characteristics sent to the Ministry of industry and trade (paragraph 8 of the draft resolution);
when executing a contract, you can not change goods from the register for products not from it (paragraph 10 of the draft resolution).
