Attention to customers!
In accordance with parts 1 and 2 of article 38 of Federal law No. 44-FZ of 05.04.2013 "on the contract system for procurement of goods, works and services for state and municipal needs "(hereinafter-Law No. 44-FZ), the creation of a contract service is:
1) the customer's obligation if the total annual volume of purchases exceeds one hundred million rubles;
2) the right of the customer, if the total annual volume of purchases of the customer does not exceed one hundred million rubles.
At the same time, if the customer has established a contract service, its activities are carried out in accordance with the regulations (regulations) developed and approved by the customer on the basis of the standard regulations (regulations) approved by the Federal Executive authority for regulating the contract system in the field of procurement.
From 27 November 2020, entered into force order of the Ministry of Finance of Russia from 31.07.2020 No. 158н "On approval of the Standard provisions (regulations) on contract service" (hereinafter – decree No. 158н) to replace the previously existing order of the Ministry of economic development of Russia dated 29.10.2013 No. 631 "On approving Standard regulations (regulations) on contract service" (repealed in accordance with the order of Ministry of economic development of Russia from 20.08.2020 No. 547).
Given the above, in order to ensure compliance with the requirements of Law No. 44-FZ and if there is a contract service, customers need to bring the regulations (regulations) on contract service in accordance with Order No. 158n.
