Customers under the Law N 223-FZ want to oblige to justify NMCD
The state Duma introduced a bill with amendments to Law N 223-FZ. If the changes are accepted, customers will have to justify the NMCD.
To do this, the purchase regulations will need to include the procedure for justifying the NMCD, the price per unit of TRU, and the procedure for determining:
NMCD;
price formulas for calculating the amounts that the customer will pay to the supplier during the execution of the contract;
the unit price of LABOR.
Customers will have 90 days from the date of entry into force of the amendments to make changes to the procurement regulations. Purchases initiated within this period and prior to the posting of the updated procurement regulations will be completed according to the old rules.
If the customer does not post the updated procurement regulations on time, they will have to apply the provisions of Law No. 44-FZ.
