Customers under the Law N 223-FZ may be required to coordinate software purchases with the import substitution Commission
The Ministry of industry and trade has prepared a draft with the specifics of approving software purchases with the import substitution Commission. Innovations will affect customers who are specified in part 1 of article 3.1-1 of the Law N 223-FZ. These include, for example, state-owned companies and business associations in which the Russian Federation's share in the authorized capital exceeds 50%.
To agree on such a purchase, customers will specify, among other things, in the request, in what form the SOFTWARE is purchased:
- on a physical carrier;
- in electronic format;
- as a right to use.
In this case, the listed options can be specified in any combination: all at once, two or one of them.
It should also be noted whether work (services) will be required for the development, modification, or modernization of SOFTWARE, whether maintenance, technical support, or updates are expected.
In addition, you must provide information about what Russian SOFTWARE is planned for purchase or justify the impossibility of purchasing domestic products.
Recall that one of the conditions for approval of the purchase is the availability of goods in the list of products that can not be purchased without approval. However, there is no information about individual SOFTWARE classes yet.
The explanatory note says that a draft government order has already been developed with a list that includes individual SOFTWARE classes in accordance with the computer program classifier. It includes software that is related to information processing for critical processes, data management, and interaction with GIS.
