The complaint is considered unfounded if it is established that the applicant could not be a participant in the procurement
The FAS received a complaint about the violation of Law N 44-FZ during the electronic auction. Note, such a complaint can be filed by any participant of the purchase.
During consideration of the complaint it became clear that information about the applicant is not in the register of participants of purchases, and also in the register of participants of electronic auction.
The Supervisory authority reminded that in order to participate in electronic procedures, accredited participants need to register with the EIS before the end of 2019. Data on such persons and documents are included in the register of participants of purchase.
Participation in the procurement is possible without registration in the EIS, if the information about the accredited participant is included in the register of participants of the electronic auction.
Since the applicant's details were not available in the registers, he could not be a participant in the procurement. The complaint was found unfounded.
