On October 1, the new rules of procurement planning will take effect. You will need to make a schedule for a longer period and specify less information in its form. The Ministry of Finance has developed a draft rules for the preparation of schedules, taking into account these innovations. They will need to plan purchases for 2020 and beyond.
For whom the rules are developed
This time, the Ministry of Finance did not separate the rules for approval of procurement plans for Federal, municipal and regional needs. The project concerns all customers according to the Law N 44-FZ.
How will make plans-schedules for a longer period
According to the amendments to the Law N 44-FZ and the draft new rules, the schedule will need to be drawn up for the duration of the law or the municipal act on the budget. For example, Federal customers will have to plan for three years.
The project clarifies: the approved schedule will have to be amended every year, taking into account the new adopted act on the budget. You will need to adjust the information for the next financial year, the first year of the planning period and Supplement the document with information on the new year of the planning period.
How much time will be spent on the formation and approval of the schedule
As now, customers will have 10 working days to approve the schedule after receiving the limits of budget obligations or approval of the plan of financial and economic activities. Schedule plans will be formed in the process of drafting and reviewing draft laws on budgets or in the planning of financial and economic activities.
What information about the purchase will need to be specified in the schedule
Amendments to the Law N 44-FZ significantly reduced the list of information that must be specified in the schedule. This list can be supplemented by the rules of formation of the schedule. In the current rules, approved by the Decrees N N 553 and 554, lists much more information than the rules that are proposed before the project.
If the project is approved:
it will not be necessary to detail the information about the object of purchase. Customers do not have to include in the form of its description, quantity of goods and scope of work and services, unit of measurement;
it will be enough to specify the amount of financial security (planned payments). You do not need to provide information about the initial maximum contract price and the price of the contract with a single supplier, the amount of the advance, the total annual volume of purchases, the stages of payment;
you do not need to report some other information about the purchase: for example, the method of procurement, the amount of security for the application and the execution of the contract, information about the benefits, prohibitions and conditions of admission, the condition of the possibility to purchase only from small businesses and socially oriented non-profit organizations
When to make changes to the schedule
Besides the bases provided by amendments to the Law N 44-FZ, the schedule suggest to change in cases if it is necessary, in particular:
clarify information about the object of purchase;
comply with the requirements of the control bodies;
recognize the purchase failed;
terminate the contract.
When should make new rules
As well as amendments to the Law N 44-FZ in terms of planning, the rules should work from October 1, 2019. They will need to be used in the preparation of procurement plans for 2020. Public discussion of the project will last until September 12.
