The Ministry of agriculture has proposed mandatory laboratory studies of safety and quality of products in the purchase of catering. Changes are planned to be made to the Law № 44-FZ.
Law No. 44-FZ will be supplemented by the principle of ensuring the quality and safety of purchased goods, works and services. The principle will be enshrined in article 12.1 of Law No. 44-FZ. Now there are six principles of the contract system:
openness and transparency;
ensuring competition and professionalism of customers;
stimulation of innovations;
the unity of the contract system;
accountability for results;
procurement efficiency.
Customers will follow the principle when planning and conducting purchases. GRBS will include in the departmental lists requirements for the quality and safety of products, as well as energy and nutritional value – for food.
When purchasing products, the contract will include three additional conditions:
The customer independently or with the assistance of laboratories conducts product research at least once every three months. If the contract is concluded for three months or less, the examination should be carried out once during the term of the contract.
The supplier pays for laboratory tests and examinations.
The customer has the right to terminate the contract unilaterally if the products do not meet the quality and safety requirements.
Time for laboratory tests in terms of acceptance of the goods will not count.
