Specifies the requirements for the criteria for the classification of goods to innovative products for the purpose of formation by the customers according to the Law No. 223-FZ of procurement plan
The government of the Russian Federation in pursuance of part 4.2 of Art. 4 of the Federal law of July 18, 2011 № 223-FZ "On procurement of goods, works, services by certain types of legal entities" (hereinafter – the Law № 223-FZ) approved the requirements for the criteria for classifying goods, works, services to innovative products and (or) high-tech products, as well as the procedure for their establishment (hereinafter – Requirements).
Recall, according to part 4 of art. 4 of Law No. 223-FZ criteria for classifying goods, works and services as innovative products and (or) high-tech products for the purpose of forming a plan for the purchase of such products (hereinafter - Criteria) are established by the Federal Executive authorities performing functions on normative legal regulation in the established field of activity, and also the state atomic energy Corporation "Rosatom", the state Corporation on space activity "Roscosmos" taking into account the priority directions of development of science, technologies and equipment approved by the President of the Russian Federation and the list of critical technologies of the Russian Federation. In particular, the Requirements established that the Criteria should take into account the economic efficiency of the product and its novelty. Also, the Criteria should meet the following criteria:
the goods are manufactured, the work is performed, the service is provided with the use of technologies and (or) equipment corresponding to the priority areas of science, technology and technology development approved by the President of the Russian Federation and (or) the list of critical technologies of the Russian Federation;
the goods are made, work is performed, the service is rendered by the organizations of hi-tech and knowledge-intensive industries;
the goods are made, work is performed, service is rendered with use of the latest samples of processing equipment, technological processes and technologies;
the goods are manufactured, the work is done, the service is provided with the participation of highly qualified personnel.
These Federal Executive authorities and state corporations must bring the previously established criteria in line with the Requirements before December 1, 2019.
