The bill developed by Department contains significant amendments to the Law N 44-FZ. Offer to abandon the documentation, leaving only a notice to adjust the timing of the placement and change of notices, sending requests for clarification of the provisions of the purchase. We will tell you about the main planned innovations.
The main document of the purchase will be a notice
In the notice, the customer will indicate the necessary information about the purchase. The previous list of information will complement what was previously indicated in the documentation. Add, for example, information about the possibility to change the contract or refuse it unilaterally.
The notice will need to be accompanied by electronic documents:
purchase object description;
the rationale for the MSPC;
requirements for the content of the application and instructions for its completion;
order of consideration and evaluation of applications for tenders and requests for proposals;
draft contract.
The right of the customer in agreement with the participant to increase the amount of goods within the NMCC at the conclusion of the contract will be permanent. Now it depends on whether there is this condition in the documentation.
Terms of announcement of tenders and requests for quotations will be reduced
Customers will have to place a notice:
for competitions — at least 15 calendar days before the deadline (now 15 working days);
for quotations — at least 4 working days before the deadline (now 5 working days).
It will be easier to make changes to the purchase
It will be possible to change the notice of any purchase 1 working day before the deadline for submission of applications. This is not currently possible to request for proposals in electronic form.
The deadline for applications will need to be extended so that it remains until the end:
at least 10 calendar days for the competition (now 10 working days);
at least 3 calendar days for "short" auctions, 7 calendar days for regular auctions (now 7 and 15 calendar days respectively);
at least 3 calendar days for requests for quotations and requests for proposals.
The participants will have more opportunities to submit requests for clarification of provisions of procurement
The right to demand clarification will appear in the participants requests for quotations and requests for proposals. You can submit your request no later than 3 calendar days before the deadline for applications.
Auction participants will be able to submit requests 5 calendar days before the deadline for applications. For participants of competitions the term will remain the same.
When to prepare for changes
Customers and bidders will have a lot of time to prepare for the changes envisaged in the project. It is expected that the amendments will enter into force 180 days from the date of publication of the law changes. At the moment, the project has not yet been submitted to the state Duma.
