The Ministry of industry and trade proposes a new ban under the national regime
The Agency proposes to prohibit the purchase of foreign goods and services, which use the goods under the code OKPD 2 26.20.2 "Storage devices and other storage devices." The aim of the project is to ensure the safety of critical infrastructure.
Participants will confirm the country of origin of the goods by the conclusion of the Ministry of industry and trade according to the government decree of 17.07.2015 № 719.
Only Russian organizations, in which the total share of Russian legal entities is more than 50 percent, will execute contracts. The exclusive right to the goods for the entire term of the contract belongs to a citizen of Russia and a Russian organization with a total 100 percent share of Russian organizations.
For example, the customer, in the performance of the contract, will find that the supplier does not meet the requirements of the regulation or has provided false information. In this case, the customer is obliged to terminate the contract unilaterally.
The ban on the admission of goods will not apply in two cases:
The procurement notice was placed in the UIS or invited to participate in the closed procurement before the regulation came into force.
The customer makes a request for quotations abroad in accordance with part 1 of article 75 of the Law № 44-FZ.
