How to change the rules of contract security from July 1

15 May 2019, Wednesday

Customers will not be able to determine the validity of the Bank guarantee

The bidder will decide for how long to provide a guarantee. However, it must in any case exceed the period of performance of obligations by at least one month. If the contractor receives a delay to complete the work, services or delivery, he will have to agree with the Bank to extend the guarantee or provide other security.

Warranty obligations will receive their own security

Customers will be required to provide the warranty obligations under the contract if the underlying obligations are to be secured.

The methods will be the same as for the main obligations: Bank guarantee or money. Choose a way to be a performer. It will be able to change the method as well as provide another Bank guarantee instead of the original one.

The size will be no more than 10% of the NMCC.

The term of the Bank guarantee shall exceed the term of the obligations for at least one month.

The order of providing the customer will establish itself. It should be noted that the contractor must provide warranty obligations before registration of documents of acceptance.

All conditions for the provision of security will need to be specified in the contract. We believe that this information should be included in other procurement documents, including in the notice, if there is a technical possibility.

The rules for securing a contract for procurement among the NSR and sonco WILL change

When purchasing from the NSR and SONKO, the amount of collateral will be calculated based on the contract price, not the NMC. In this case, the security should not be less than the advance.

The winner will not be able to provide security at all if he / she sends the customer information from the contract register confirming that he / she has performed three contracts without penalties and penalties within three years prior to the application. The total amount of contracts shall not be less than the MSPC.
