The Ministry of Finance of Russia has explained features of distribution of the report on the execution of the contract in the EIS after July 1

The specialists of the Ministry replied to the question of how customers should apply the provisions of the Federal law dated 5 April 2013 No. 44-FZ "On contract system in procurement of goods, works, services for state and municipal needs" (hereinafter – the Law № 44-FZ) in the part providing information concerning the concluded contract to the Federal Treasury and placing appropriate information in the EIS after the entry into force of the Federal law from December 31, 2017.  No. 504-FZ " on amendments to the Federal law "on the contract system in the procurement of goods, works and services for state and municipal needs" (hereinafter – the Law No. 504-FZ) (letter No. 24-03-07/34121 of the Ministry of Finance of the Russian Federation of may 18, 2018).

In particular, it is explained that if the obligation to place the report on the execution of the contract in the EIS for the customer began before July 1, the report is made available in accordance with the requirements of part 9 of article 94 of Law No. 44-FZ, established before the entry into force of Act No. 504-FZ.

In this case, if the contract is concluded before July 1, but the obligation to place a report on the performance of the contract in the UIS for the customer came after the specified date, the report is placed taking into account the changes that have entered into force in part 9 of article 94 of the Law № 44-FZ.

Recall, from July 1, the results of a separate stage of the contract are included in the report on its execution only in the cases specified in the Law № 44-FZ. Thus, the customer must reflect in the report published in the EIS the results of a separate stage of the contract in cases if the subject of the contract is the execution of works on construction, reconstruction, overhaul of capital construction, preservation of cultural heritage (historical and cultural monuments) of the peoples of the Russian Federation or the contract price exceeds 1 billion rubles.

Thus, according to h. 3 Art. 103 of the Law No. 44-FZ (in edition of the Law No. 504-FZ), the customer is obliged to send to Federal Treasury the information listed in this norm within 5, instead of 3 working days from the date of the conclusion, change, execution, termination of the contract, acceptance of goods, works, services.
