You can not reject an application if the product does not formally meet the requirements of the state customer
The customer wanted to purchase printers, one of the requirements for which was the possibility of using paper of a certain density. The range of values of this indicator was given in the documentation.
The procurement participant indicated in the application an extended range. He clarified that the proposed printers will be able to work with paper, the characteristics of which the customer outlined in the documentation.
The commission rejected the application of the participant. However, the FAS Russia found such a decision unlawful.
If the characteristics of the goods overlap with the requirements for it, then this product meets the needs of the customer. In such situations, you should not reject the application.
