In accordance with Federal Law No. 124-FL dated 05/29/2024, signed by the President of the Russian Federation, some provisions of Law No. 44-FL are being adjusted. In particular, the new version contains the definition of the concept of "customer" provided for in paragraph 7 of part 1 of Article 3 of Law No. 44-FL, which is now explained, among other things, by the legal entities specified in Part 4, Part 4.3 and Part 4.4 of Article 15 of Law No. 44-FL.

The Federal Treasury reminds federal recipients of budgetary funds about the expiration of deadlines for payment of monetary obligations under state contracts for the supply of goods, performance of works, provision of services, which, in accordance with the terms of these contracts, are subject to payment in the reporting financial year due to the limits of budgetary obligations for these purposes brought to them in accordance with the established procedure.

On May 26 of this year, a new Article 6.1-1 of Law No. 275-FL will enter into force, providing for the creation of a federal product cataloging system for federal needs designed to provide information to government customers, lead performers and performers regarding technical and qualitative characteristics, operating conditions of supplies, their developers, manufacturers and suppliers during formation, placement and the fulfillment of the state defense order. In particular, a federal catalog of products for federal needs is being introduced (hereinafter referred to as the Catalog), which must be applied by government customers, lead contractors and executors when forming, placing and executing state defense orders.

The specialists of the ministry, in particular, recalled the temporary right of customers provided for in Part 64.1 of Article 112 of Law No. 44-FZ not to establish until December 31, 2024 the requirement to ensure the performance of the contract, guarantee obligations (except if the contract provides for the payment of an advance payment and at the same time calculations in part of the advance are not subject to treasury support). At the same time, the letter emphasizes that if the customer does not establish a requirement to ensure the performance of the contract, anti-dumping measures during the tender and auction provided for in art. 37 of Law No. 44-FZ, do not apply.
