The Ministry of Finance against concession to third parties of any requirements of executors to the state customer

The department, as before, continues to believe that the identity of the supplier is of significant importance to the customer. The assignment of claims under contracts contradicts budgetary legislation. The right can not even transfer to claim for reimbursement of court expenses.

It is interesting that the Ministry of Finance refers to last year's refuse definitions Supreme Court of RF. However, the Supreme Court itself in a review of the jurisprudence of 2017 expressed a slightly different opinion. It allowed a concession of the right of claim to the state customer about the fulfillment of the monetary obligation.

Participants who will give in to the right of a monetary claim to the customer, taking into account the approach of the Ministry of Finance, will have to defend the position in court. Customers who are faced with such a concession should not rush and refuse a new creditor in payment. First, it needs to assess the prospects for litigation.
