It is necessary to change the contract signed by the unitary enterprise till January 1, 2017 taking into account 223-FZ

The Ministry of Economic Development has made recommendations for cases when it is required to change the contract signed by federal state unitary enterprise before transition to purchases on 44-FZ. In these situations it is necessary to make changes according to provisions of the Civil Code of the Russian Federation and the Law N 223-FZ. It agrees to the last of change it is necessary to reflect in the register of contracts.
The ministry has mentioned in the letter only federal state unitary enterprise. We believe, the position of department can be applied also to other unitary enterprises.
The law N 223-FZ demands: if at performance of the contract change the volume of the purchased goods, works, services, their price, dates of performance, then data on changes with the indication of the changed conditions should be placed in EIS. It is necessary to make it no later than 10 days from the date of modification.
For non-stationing of such data the penalty is provided in EIS. His size for officials makes from 30 thousand to 50 thousand rubles, for legal persons - from 100 thousand to 300 thousand rubles.
