The state customer can establish in the contract the volume of involvement of subcontractors from small business higher than 5%

Recommendations of the Ministry of Economic Development will be useful to the customer at inclusion in the contract of a standard condition on involvement of subcontractors, collaborators from among SMP and COHKO.
Such condition provides the following: the performer of the state contract has to attract small business entities, socially oriented non-profit organizations of not less than 5% of the price of the contract. In practice there is a question of that, the customer can specify bigger volume in the draft contract or it is necessary to transfer a standard condition without changes.
The Ministry of Economic Development has made explanations about it. So, the customer has the right to establish the volume of attraction of SMP and COHKO at the rate from 5% of the price of the contract above.
We will remind, the customer is obliged to carry out purchases at SMP and COHKO of not less than 15% of the cumulative annual volume of purchases calculated taking into account provisions of the Law N 44-FZ. It is possible to observe this indicator due to attraction of SMP and COHKO as collaborators.
If to make purchase at SMP and COHKO in smaller volume, the official of the customer can be fined 50 thousand rubles.
