The ministry notes in the letter again that when purchasing under the Law N 223-FZ the goods coming from EEU, and also the services and works rendered and which are carried out by persons from this union have on an equal basis with domestic a priority before foreign goods, and also the services and works rendered and which are carried out by foreign persons.
The ministry refers to the Resolution N 925. When purchasing under the Law N 223-FZ it establishes a priority:
- goods of the Russian origin before foreign;
- the services and works rendered and which are carried out by Russian persons in relation to works, services of foreign persons.
According to the Resolution N 925 the priority is established taking into account the General Agreement on Tariffs and Trade and the Contract on EEU.
According to the Ministry of Economic Development, it allows to provide a similar priority to the goods coming from EEU and also the services and works rendered and which are carried out by persons from this union. We will remind, he along with Russia and Belarus includes Kazakhstan, Armenia and Kyrgyzstan.
That the customer could provide a priority under the Resolution N 925, it is necessary to include a number of conditions in the provision on purchase and documentation. For example, the requirement that the participant has to specify the country of goods' origin in the application.
