The term of request for an explanation of auction documentation lasts if terminates in day off

Such conclusion can be drawn from explanations of the Ministry of Economic Development. Department noted: if the last day of term of receipt to the customer of requests about an explanation of auction documentation - a day off, then day of the termination of this term is the working day following it.
The state agency adhered to the similar point of view also earlier. At the same time he emphasized that the customer is obliged to provide explanations of the auction documentation.
In the new letter, as well as in former, the ministry "proved" a conclusion by provisions Civil Codes of the Russian Federation. In particular, if the last day of term falls on non-working day, then the next working day following it is considered the moment of its termination.
We believe, customers should be guided by a line item of the Ministry of Economic Development in case of creation of auction documentation. In it the customer shall establish provision term to procurement participants of explanations. Determining it, it is necessary to consider the term of receipt of requests about an explanation of auction documentation.
If the customer ignores explanations of department, his official can be fined 3 thousand rubles.
