The state customer pays the contract and returns its providing only to the contractor specified in the contract

Such opinion was expressed again by the Ministry of Economic Development. The state agency came to a similar conclusion more than once, for example "in December of last year".
Department emphasized that it is possible to pay the contract and to return its providing only to the contractor whose payment details are specified in the contract.
The conclusion founds the ministry on provisions BQ of the Russian Federation. In case of authorization of payment under the contract it is in addition checked whether there correspond to terms of the contract the following data:
- data on the contract from the register of contracts;
- data on the budget obligation assumed on accounting under this contract.
We believe if these data differ, payment of the contract and transfer of providing it will be refused.
It is possible to draw a conclusion that in explanations of the Ministry of Economic Development it is about such method of ensuring performance of the contract as introduction of a money into the account specified by the customer. In the contract the customer shall establish providing return terms. If not to include this condition in the contract, the official of the customer can be fined 3 thousand rubles.
