Irrespective of the price data on all subcontractors can oblige to report contractors of state contracts

"Project" with such amendments to the Law N 44-FZ is under consideration in the State Duma.

According to the document suppliers, contractors and contractors irrespective of the price of the contract will represent to the customer of the information about collaborators and subcontractors under all agreements. Also it will be necessary to send to the copy of the signed agreements.

Now contractors of state contracts shall report on collaborators and subcontractors to the customer if the starting (maximum) price of the contract:

- it is more than 1 billion rubles when purchasing for federal needs;

- it is more than 100 million rubles when purchasing for needs of subjects and municipal needs.

In case of the called purchases it is necessary to represent data only on subcontractors and collaborators, the price of the agreement or a total price of all signed agreements with which exceeds 10% of the price of the contract.

Let's remind, under the Law N 44-FZ in the contract there shall be a condition about responsibility for non-presentation of the specified information. So, a penalty fee in the amount of 1/300 their payments operating for date of a refunding rate of the Central Bank of the Russian Federation from the price of the contract with the collaborator, a subcontractor is collected from the contractor. A penalty fee is subject to charge for each day of obligation fulfillment delay.

Besides, information on non-presentation of information about subcontractors and collaborators is placed in EIS. At the same time non-presentation of such data doesn't attract invalidity of the signed contract on this basis.
