It is offered to oblige participants of state procurements to pay the state duty for submission of the complaint in control body

The relevant amendments to the Law N 44-FZ are under consideration of the State Duma since the end of December. If to adopt the bill, then it is necessary to attach the document confirming payment of the national duty to the claim. What can become its size, is not clear so far.

Now participants of state procurements, public associations and associations of legal persons have the right to make "free of charge" the complaint in case of violation of the rights and legitimate interests of the procurement participant.

Let's remind, the complaint is made in regulatory authority in the sphere of state procurements. Treat regulatory authorities:

- FAS Russia;

- authorized bodies of the executive authority of territorial subjects of the Russian Federation;

- authorized bodies of local self-government.

The regulatory authority gets out depending on for what needs purchase was made.

The developer of the project notes that often the purpose of submission of the claim - delay in a procurement procedure and the conclusion of the contract. If to establish the national duty for submission of the claim, the author of an initiative believes, it will be possible to avoid such abuses.

Whether these expectations will be met, it will become more clear when offers on determination of the size of the national duty appear.
