The customer on 223-FL has the right to provide a possibility of accomplishment and payment for work to the conclusion of the agreement

This option of actions of the parties can be included in regulations on purchase. Such opinion "was expressed by the Ministry of Economic Development". And it is possible to apply a conclusion provided that the winner of purchase will perform works.

We believe, a conclusion of the ministry concerns a situation when by regulations on purchase the agreement is signed through certain time after its carrying out.

The ministry reminded that on Russian Federation  Civil Code  the party can extend action of terms of the contract to the relations which arose to its conclusion. It is applicable also when purchasing under the Law N 223-FL as Russian Federation  Civil Code "treats" the regulations regulating such purchases.
