State procurement of services of insurance: lump sum payment of an insurance premium isn't recognized in the 100% advance payment

Such conclusion was drawn by the Ministry of Economic Development in "letter", having referred to regulations Civil Codes of the Russian Federation on an insurance premium. Department explained that in the considered situation the state customer by the general rule is obliged to demand from the participant to provide providing the contract.

We believe, explanations of the ministry will be useful when it is necessary to determine the amount of providing the contract in case of state procurement of services of insurance with lump sum payment of an insurance premium.

Under the Law N 44-FL the amount of providing can be equal to advance payment. For example, this rule works if the size of advance payment is more than 30% of the starting (maximum) price of the contract. Considering this provision and a line item of the Ministry of Economic Development, it is possible to come to the following conclusion. The state customer shan't specify in documentation on purchase the amount of providing proceeding from an insurance premium.
