The Ministry of Labour and Social Protection of the Russian Federation reminds of the ban to give and receive gifts

On the eve of New Year's and Christmas holidays the Ministry of Labour and Social Protection of the Russian Federation has sent the information letter with a reminder on existence of legislatively established ban to give and receive gifts.

In the Civil Code of the Russian Federation and a row regulatory legal acts of the Russian Federation (federal laws "About Anti-corruption", "About the Public Civil Service of the Russian Federation") the prohibition on donation of gifts to the persons replacing the state and municipal positions, to the government and local government officers, the bank clerk of Russia, employees of the state corporations (companies), state non-budgetary funds and also on receipt of gifts by them from physical persons and legal entities is established.

According to the Civil Code of the Russian Federation the gifts received by specified persons in connection with hospitality events, official journeys and other official actions are recognized property of the Russian Federation, subjects of the Russian Federation and municipalities.

Ministry of Labor of Russia reminds, receipt of gifts by the corresponding persons in other cases is violation of a prohibition, creates conditions for emergence of a conflict of interest, calls into question objectivity of the decisions made by them, and also attracts responsibility, stipulated by the legislation, up to dismissal in connection with loss of trust and in case the gift is regarded as a bribe - criminal liability.
