The customer does not change the amount of the security, if the contract is changed due to the reduction limits

If the material terms of the contract vary due to the decrease reported to the customer's budget commitments limits the size of maintenance of execution of the contract is not necessary to reduce. This position was expressed by the Economic Development Ministry.

Conclusion Office makes to the provisions of Law N 44-FZ on ensuring execution of the contract. The size of such a guarantee should be calculated from the initial (maximum) contract price specified in the notice of the purchase. Reducing brought to the customer's limits on the price is not affected.

Changing the essential conditions of the contract shall be allowed only in cases stipulated by the Law N 44-FZ. One of them - the reduction in previously reported to the customer limits of budgetary obligations. In this situation, the customer must ensure coordination of the new terms of the contract with the counterparty.
