It is possible to sign the agreement on 223-FL only in 10 days after placement of the final protocol

Such term is allotted by the legislation on appeal of actions, failure to act of the customer. If the customer provides in regulations on purchase 223-FL less time for the conclusion of agreements, it will limit the right of participants to appeal.

As noted the Ministry of Economic Development, according to the Marine life protection act of the competition participants have 10 days on appeal of actions, failure to act of the customer. Term is estimated or from the date of summarizing the bidding results on 223-FZ, or from the date of placement of their results in a unified information system.

If the customer doesn't consider it in regulations on purchase and will establish a smaller closing date of the agreement following the results of the biddings, for example five days, then its actions will be directed against the rights of procurement participants. In that case the antimonopoly authority in the presence of violations won't manage to take necessary measures to the conclusion of the contract. And the address of procurement participants with the claim will be deprived of a legal sense as the agreement can be already signed.
