The state customer shall specify in the contract from what budget of level purchase is financed

These data, according to the Ministry of Economic Development, need to be included also in the notice, procurement documentation and the draft contract. From "former explanations" of department it is clear that a financing source - an essential term of the contract. Without such condition it can recognize unconcluded.

The line item of department is proved by the fact that under the Law N 44-FL the source of financing shall be specified in the notice. In turn, it is necessary to reflect data from the notice in procurement documentation. The contract is signed on the conditions provided in the notice and documentation. Means, in all three documents there shall be information on a financing source. If it means from the budget, it is necessary to specify its level - federal, regional or local.

As appears from the Civil Code of the Russian Federation, the agreement is considered unconcluded if essential conditions aren't approved. For example, the court can recognize unconcluded the contract in which the financing source isn't specified. In that case the customer and the supplier shall return superficially received property or compensate its cost. Besides, the official of the customer can be fined 3 thousand rubles for the fact that documentation is approved with violation of the law N 44-FL.
