Since September 3 restrictions of the admission to purchases of separate foreign products work

According to Art. 14 of the Law N 44-FL the List of separate types of the foodstuff coming from foreign states concerning which restrictions of the admission for the purposes of implementation of purchases for ensuring the state and municipal needs are set is approved.

Restrictions of the admission to purchases extend to the foodstuff included in the List coming from foreign states except for state members of EEU. Confirmation of a country of source of foodstuff is specifying (declaring) by the procurement participant in the request according to the Law N 44-FL of the name of a country of source and the producer of foodstuff. At the same time the name of a country of source of foodstuff is specified according to the All-Russian qualifier of the countries of the world.

Restrictions of the admission work when purchasing with competitive methods and consist in the following. When purchasing the foodstuff included in the List, the customer is obliged to reject the requests and final offers containing offers on delivery of foreign foodstuff if on participation in purchase it is submitted at least 2 notices conforming to requirements and (or) documentation on purchase of requests, final offers which at the same time:

- contain offers on delivery of types of the foodstuff which is subject to purchase which country of source are state members of EEU;

- don't contain offers on delivery of the same type of foodstuff of one producer.

Restrictions of the admission aren't applied to purchases in two cases:

- if placement of notices on implementation of purchases of the foodstuff included in the List in EIS and (or) the direction of invitations to take part in determination of the supplier are performed by the closed method till September 3, 2016;

- if purchases of the foodstuff included in the List are performed by the customers specified in p.1 Art. 75 of the Law N 44-FL in the territory of a foreign state for ensuring the activities in this territory.
