Whether the customer is obliged to grant in 2016 to the partner a payment deferral of penalties and (or) to write off the added amounts of penalties?

According to specialists of the Ministry of Economic Development of the Russian Federation, of 14.03.2016 N 190 "About cases and an order of provision by the customer in 2016 of a payment deferral of penalties (penalties, a penalty fee) and (or) implementation of write-off of the added amounts of penalties (penalties, a penalty fee)" follows from item 1 of the order of the Government of the Russian Federation that application of this Resolution is an obligation for customers. At the same time representatives of department emphasize that provisions both the Law N 44-FL, and the Resolution N 190 didn't establish the requirement about availability in the contract of a condition about a possibility of write-off of the added amounts of penalties (penalties, a penalty fee).
