The customer himself establishes the term to which it is necessary to return ensuring performance of the contract

Under the Law N 44-Fl it is necessary to provide a condition about the terms of a refund brought as ensuring performance of the contract in the contract. According to the Ministry of Economic Development, the customer determines this condition and includes in the contract independently.

From explanations of department it is possible to draw a conclusion that the customer also has the right to establish in the contract an order in which the providing the contract brought in the form of a money decreases. If it is necessary to reduce the providing the contract provided in the form of the bank guarantee it is necessary to obtain a new guarantee.
