Purchase under the Law N 223-FL: the order of participation of a group of persons should be enshrined in documentation

As the order of participation of a group of persons in the purchases which are carried out under the Law N 223-FL legislatively isn't regulated, the Ministry of Economic Development considers that the customer should establish this order in documentation on purchase. We believe, it needs to be reflected also in regulations on purchase.

Department notes: it is reasonable to provide, for example, the separate commitment form allowing each member of group to confirm the fact of participation in purchase. The group in general, but not the separate legal entity which is its part shall conform to requirements of documentation. If purchase is won by a group of persons, the customer should sign one contract with all members of group. To sign its having the right person which received such powers from other members of group.
