If on the charter of the participant there is no mark about state registration, the request cannot be rejected

The law N 44-FL does not provide the right of the auction commission to recognize the request not of the corresponding documentation because the charter of the participant contradicts requirements of the legislation.

According to court, the customer illegally recognized the request of documentation which is not conforming to requirements. The reason was the fact that on the copy of the charter there was no mark about registration.

The operator of an electronic trading platform has not refused to the participant accreditation though on the copy of the charter there was no mark about registration. Besides, the verified copy of the certificate of incorporation which contained necessary information has been provided.
