Date of exclusion of data from the RUS does not depend on the effective date of their entering into Register

In the register of unfair suppliers (RUS) data on participants were made late. The court ordered the competition authority to exclude them from the register at the end of two years from the date when the information should have been reflected in it, and not from the date of the actual entry of data.

The information must be included in the RUS within three working days from the date on which the corresponding decision. This rule was not complied: the data have brought to the registry with a delay of almost five months. The Court did not accept the arguments of FAS, according to which the attention of the RUS should be deleted after the expiration of two years from the date of the actual introduction of the registry.

If you do not keep within in a timely entry to the RUS, is possible to violate the rights of the participants in the sphere of economic activity. In this case, society could not participate in purchases, while the information about it is not removed from the RUS.
